PLEASE READ THIS AGREEMENT CAREFULLY.
 
      BECAUSE OF THE RISKS OF COVID-19, THE AGREEMENT INCLUDES A RELEASE AND CONTAINS
     CERTAIN OBLIGATIONS YOU HAVE IN ORDER TO ATTEND SERVICES AT BETH SHALOM.

AGREEMENT AND WAIVER
This Agreement and Waiver (“Agreement”) is between the congregant(s) who electronically sign this Agreement by clicking on the “SUBMIT” button below and Congregation Beth Shalom, Inc. (“CBS”).
CBS wants to make in-person services available again, albeit initially for a limited number of congregants.  The primary goal of CBS is to allow in-person services to resume in a safe a manner – to the extent it can – and to protect all congregants who choose to attend.
I/We (“We” and “Our”) desire to attend services at CBS, despite the on-going COVID-19 pandemic and risks of contagion.  We also want to make other congregants who attend as comfortable as possible and reduce their risks of contracting COVID-19. 
Accordingly, we will diligently comply with Our requirements under this Agreement – even if we do not believe the measures are necessary.
We understand that, although CBS will be taking reasonable steps to reduce the likelihood of any congregant contracting COVID-19 while on the premises, even with these measures, no assurance can be given that those attending services will not contract COVID-19 or that all risks of contracting COVID-19 can be eliminated.
In order to be allowed to attend services, We also understand We have important responsibilities, referenced below, to protect other congregants attending services. 
For these reasons, We do hereby agree to and acknowledge the following:
1. Risks of COVID-19.  We hereby acknowledge that Coronavirus, COVID-19 is an extremely contagious virus. COVID-19 can lead to severe illness, personal injury, permanent disability and death.  Federal and state authorities recommend social distancing as a mean to prevent the spread of the virus. Risks are greater for those sixty-five years and older and those with certain medical conditions.  Attending services will increase the risk of contracting COVID-19. CBS can in no way warrant that COVID-19 transmission will not occur while accessing the CBS facilities.
Consistent with language in Title 51, Chapter 16 of the Official Code of Georgia, we are on notice that
Any person entering the premises waives all civil liability against this premises owner and operator for any injuries caused by the inherent risk associated with contracting COVID-19 at public gatherings, except for gross negligence, willful and wanton misconduct, reckless infliction of harm, or intentional infliction of harm, by the individual or entity of the premises
2.  We Are Not Sick.  We and, if we bring Our children, they, too, will meet the conditions of Exhibit A of this Agreement in order to protect other congregants at services.  Please read Exhibit A below carefully.
Because we want to protect all congregants at services, We hereby certify and represent that we meet the requirements of Exhibit A.
3.  Safety Precautions at Shul.  Because we want to protect all congregants at services, upon arrival We and, if we bring Our children, they, too, will comply with each requirement of Exhibit B of this Agreement.  Please read Exhibit B below carefully.
4.  Release and Waiver. We also understand by attending services, We are assuming risks because of the risks of contagion. We will not hold CBS or any congregant responsible in the event We become sick. We waive any claims and assume all risks, as detailed below and as is consistent with Title 51, Chapter 16 of the Georgia Code.
We hereby for Ourselves and on behalf of any children we bring to services release, waive and discharge CBS and each of its board members, trustees, officers, employees, volunteers, congregants, agents and contractors (hereinafter “Releasees”), as a result of any infection or other result from COVID-19 for any and all loss, damage or expense to the Us, and any claims or demands on account of injury or sickness to the person or resulting in Our death or Our children arising out of or related to the Our coming into the CBS building, including use of any facilities.  We expressly assume all risks, as well as all responsibility for any medical expenses or other costs based on a claim that We or Our children contracted COVID-19.
We have read Agreement and Waiver, fully understand its terms, understand that We have given up substantial rights by Our signing it, and have signed it freely and voluntarily.
We have legally signed this Agreement by clicking “SUBMIT” below.

Exhibit A
We will not attend services if we think We or Our children may have COVID-19.
We and any children attending services will meet these requirements or, otherwise, We will not enter the CBS building:
1.  During the week before and on the day we come, We must be free from COVID-19 symptoms.  Symptoms include:
  • fever of approx. 100.4 degrees Fahrenheit or higher
  • dry cough
  • loss of taste or smell
  • muscle aches
  • shortness of breath
  • sore throat
  • chills
  • headache
  • gastro symptoms
 
While we understand that many of these symptoms can also be related to non-COVID-19 related issues, we must proceed with an abundance of caution during this pandemic.  These symptoms typically appear from 2-7 days after being infected so please take them seriously.
2.  We have not been asked to quarantine or been exposed to any person to Our knowledge (i) diagnosed with COVID-19, (ii) having COVID symptoms or (iii) who is presumed to have COVID-19.
We will practice all recommended social distancing, exposure limiting practices recommended by the CDC.  We will follow any recommendations from the CDC that limits my Our risk for exposure, including wearing a mask in all public areas and remaining a minimum of six feet from all other people.
We understand that no list of restrictions, guidelines or practices will remove 100% of the risk of exposure to COVID-19 as the virus can be transmitted by persons who are asymptomatic, i.e., before some people show signs of infection.  We understand that We play a crucial role in keeping other congregants safe and reducing the risk of exposure by following these requirements. 
Exhibit B
We may not agree with all of these measures, but agree to strictly comply with them in order for all congregants to be as reasonably comfortable attending services as they can be:
1.  We understand that
  • Our temperature will be taken upon arrival.  If it is 100.4 or greater, We will not be able to attend services.
  • If we do not appear well, We will not be able to attend services.
  • We will be asked upon arrival to affirm we have no COVID symptoms.
  • We must at all times wear an appropriate mask while in the building.
  • We will comply with the directions given by CBS ushers.
  • We must sit in areas where We are directed by the usher and, at all times, socially distance from every other congregant while in the building.
  • Access to the restrooms will be restricted to one person at a time.
  • Wash hands with hand sanitizer when entering and leaving the building.
2.  We will each bring Our own mask, kippa and talit.
3.  We will immediately notify CBS if We become aware of any person with whom We have had contact within fourteen (14) days of attending the service, wherever that  might have occurred (i) exhibits any of the symptoms listed in Exhibit A, above, (ii) is advised to self-isolate, quarantine, or has tested positive, or (iii) is presumed positive for COVID-19.
